This page is being expanded to cover OverBuild Labs hardware products (OverMiner Nano firmware and OverMiner Lite finished hardware), the OverManager platform, our mobile applications, and dispute resolution. The newer sections below are working drafts awaiting review by qualified legal counsel and may change without notice. They are published here as a good-faith expression of our intent to inform users of applicable risks; they do not represent a finalized legal agreement. Use of any OverBuild Labs software or hardware nevertheless constitutes acknowledgement of the risks described.
Beta Software Notice
All OverBuild Labs software, including the solo mining pool, OverManager, OverManager Mobile, OverMobile, and OverMiner firmware, is currently in active development and may be considered beta software. Features may change, bugs are expected, and downtime may occur. Use at your own risk.
1. "As-Is" Disclaimer
All software, hardware, services, and content provided by OverBuild Labs ("the Service") are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. OverBuild Labs does not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components.
2. Limitation of Liability
To the maximum extent permitted by law, in no event shall OverBuild Labs, its operators, contributors, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, lost mining rewards, hardware damage, property damage, personal injury, data loss, business interruption, or any other commercial damages or losses, arising out of or related to your use of (or inability to use) the Service.
3. Cryptocurrency Mining Risk
Cryptocurrency mining involves financial, hardware, and energy risks. By using OverBuild Labs services, software, or hardware you acknowledge and accept that:
- Mining results are not guaranteed and depend on network difficulty, luck, and hardware performance.
- You are responsible for verifying that the wallet address you provide is correct. Block rewards sent to an incorrect address cannot be recovered.
- Mining hardware can experience wear, overheating, or failure. You assume all responsibility for the operation and maintenance of your equipment.
- Cryptocurrency values are volatile. OverBuild Labs makes no claims about the future value of any coin.
- You are responsible for understanding and complying with applicable tax and legal obligations in your jurisdiction.
- OverMiner devices are lottery-tier miners. Statistically, an individual device may operate for years without finding a block. Do not purchase or build one expecting any specific return, including any return at all.
4. Solo Mining Pool
The OverBuild Labs solo mining pool forwards block rewards directly to the wallet address provided by the miner. OverBuild Labs does not custody, hold, or distribute any funds. The pool charges no fees, but accepts voluntary donations. Service availability is best-effort and is not guaranteed.
5. Software & Third-Party Components
OverBuild Labs software may include or rely on third-party open-source components, each governed by its own license. OverBuild Labs is not responsible for the behavior, security, or accuracy of third-party software. OverManager, OverManager Mobile, OverMobile, OverMiner firmware, and related tools are provided without any guarantee of performance, compatibility, or fitness for any specific device or use case.
6. OverManager Platform (SaaS)
OverManager — including the OverManager desktop application and the hosted OverManager Cloud service — is a platform for configuring, monitoring, and managing compatible mining devices, from OverMiner ESP32 devices to third-party ASIC miners. By creating an account or connecting a device to OverManager, you agree to the following:
- Accounts. You must provide accurate registration information and keep your credentials secure. You are responsible for all activity that occurs under your account. Accounts are for your own use and may not be shared, sold, or transferred.
- Device telemetry. Connected devices transmit operational telemetry to OverManager — including hashrate, share statistics, temperature, uptime, firmware version, device identifiers, and network connection data — which we collect and process in order to provide the Service. By connecting a device, you consent to this collection.
- Suspension and termination. OverBuild Labs reserves the absolute right, at its sole discretion and with or without notice, to suspend or terminate any account or device connection that it reasonably believes is engaged in abuse of the platform, malicious activity, attacks on our infrastructure or other users, fraud, unauthorized access attempts, or any unlawful use. We are not liable for any loss resulting from such suspension or termination.
- No uptime guarantee. OverManager is provided without any service-level commitment. OverBuild Labs is not liable for server downtime, maintenance windows, outages, or lost or degraded connections between the platform and your miners, including any resulting loss of monitoring data, missed alerts, or lost mining time or rewards. Your miners operate independently of OverManager; the platform is a management convenience, not a component your mining should depend on.
- Third-party ASIC control. OverManager can discover and send configuration commands to third-party ASIC miners (such as IceRiver, Bitmain Antminer, and Whatsminer/MicroBT devices). OverBuild Labs is not affiliated with, endorsed by, or responsible for those manufacturers or their hardware. Misconfiguration — including an incorrect pool, port, or difficulty tier — can cause an ASIC to stall, freeze, or mine to an unintended destination. You are solely responsible for reviewing and verifying every configuration change you apply through the platform, and OverBuild Labs is not liable for downtime, lost hashrate, lost rewards, or hardware damage resulting from configuration applied to your devices.
7. Mobile Applications
OverBuild Labs distributes mobile software in two distinct categories with different capabilities and risk profiles. Read the part that applies to the app and platform you are using.
OverManager Mobile (iOS and Android)
OverManager Mobile, our companion application for iOS and Android, is strictly a remote monitoring and management tool for external hardware and your OverManager account. It does not perform, and cannot be used to perform, any cryptocurrency mining on the mobile device itself and does not use the device's CPU, GPU, or other resources to compute hashes or mine any cryptocurrency.
For users who download OverManager Mobile from the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and OverBuild Labs only. Apple Inc. is not a party to these Terms and does not own and is not responsible for the app.
- Apple has no obligation whatsoever to furnish any maintenance or support services for the app, and no liability for any claims relating to the app, including product liability claims, claims of failure to conform to legal or regulatory requirements, consumer protection claims, or intellectual-property claims.
- Your use of the app must also comply with the Apple Media Services Terms and Conditions, including the Usage Rules.
- Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license to use the app, and may enforce them against you.
For users who download OverManager Mobile from Google Play, the equivalent applies: these Terms are between you and OverBuild Labs only; Google LLC is not a party to these Terms, is not responsible for the app, and has no obligation to provide maintenance or support for it. Your use must also comply with the Google Play Terms of Service.
OverMobile for Android (on-device miner)
OverMobile for Android is different: it performs real cryptocurrency mining on the Android device itself. Because Google Play policy prohibits on-device mining, OverMobile is distributed exclusively outside Google Play (direct APK, F-Droid, and Obtainium). It is not distributed through, endorsed by, or associated with Google Play, and Google has no responsibility for it. By installing OverMobile you acknowledge and accept that:
- On-device mining is computationally intensive. It generates heat, consumes significant power, accelerates battery wear, and may shorten the useful life of your device. Sustained mining on inadequate hardware or a degraded battery can cause device failure. You assume all risk of damage to the device on which you run OverMobile.
- Sideloading software carries inherent risk. You are responsible for obtaining OverMobile only from our official distribution channels and verifying the integrity of what you install. Running the app may affect your device manufacturer's warranty.
- Mining on a phone is lottery-tier at best. The statistical realities described in the Cryptocurrency Mining Risk section apply with full force: expect no return, including no return at all.
8. Hardware & DIY Devices
OverBuild Labs develops open-source firmware (such as OverMiner Nano) and may sell limited-run finished hardware (such as OverMiner Lite) directly or through third-party marketplaces. Regardless of whether you flash our firmware on a board you sourced yourself or purchase a pre-flashed device from us, all hardware is provided "AS IS, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND." We disclaim all implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
You acknowledge that:
- OverMiner devices are based on commodity ESP32 development boards manufactured by third parties. OverBuild Labs is not the manufacturer of those boards and makes no representations about their certification status (FCC, CE, UKCA, RCM, or other regulatory marks). It is your responsibility to verify that operating the device is lawful in your jurisdiction.
- The devices generate heat during operation. You assume all responsibility for providing adequate ventilation, using a properly rated USB power supply (5V DC, sufficient amperage for the device), supervising the device during initial use, and following any safety instructions in the documentation.
- You will not operate the device in a manner that could cause injury, fire, or property damage, including but not limited to: covering ventilation openings, exceeding rated input voltage or current, immersing the device in liquids, operating it in the presence of flammable materials, or modifying the device in ways that defeat thermal limits.
- Hardware sold by OverBuild Labs through third-party marketplaces is also subject to the policies of that marketplace.
3D-printed novelty products. OverBuild Labs also sells 3D-printed crypto-themed novelty items (such as Kaspa and Bitcoin models). These products are decorative and educational items only — they do not mine cryptocurrency and have no monetary or functional value. As is inherent to additive manufacturing, they may exhibit minor cosmetic imperfections such as layer lines, small surface blemishes, or slight color variation; these characteristics are normal and are not defects.
9. Firmware & Flashing Risk
Flashing custom firmware to a hardware device may void any manufacturer warranty on that device, may render the device temporarily or permanently inoperable ("bricking"), and is performed entirely at your own risk. OverBuild Labs provides firmware images and documentation as a convenience and is not responsible for any damage, data loss, or device failure resulting from flashing, configuration, or operation. You are responsible for verifying the integrity of any downloaded firmware and using it on hardware you own or have authorization to modify.
10. No Financial Advice
Nothing on this website or in any OverBuild Labs software constitutes financial, investment, legal, or tax advice. All content is provided for informational purposes only. You should consult qualified professionals before making any decisions based on the content provided here.
11. User Responsibilities
You agree to use OverBuild Labs services, software, and hardware in compliance with all applicable laws and regulations. You are solely responsible for the security of your wallets, private keys, and any devices used to access the Service. OverBuild Labs cannot recover lost wallets, keys, or rewards on your behalf.
12. Data Privacy
Personal data collected through this website, OverManager, OverManager Mobile, and OverMobile — including account information and device telemetry — is collected and processed in accordance with the OverBuild Labs Privacy Policy, which is maintained in alignment with the Texas Data Privacy and Security Act (TDPSA). Wallet addresses submitted to the solo mining pool are used solely to direct block rewards and are inherently public on the relevant blockchain. Review the Privacy Policy for details on what we collect, why, how long we retain it, and the rights available to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless OverBuild Labs, its operators, contributors, and affiliates from any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use, misuse, modification, redistribution, or operation of any OverBuild Labs software or hardware; (b) any third-party claim that your use of the Service or any device infringes their rights; or (c) your violation of these Terms or any applicable law.
14. Governing Law, Arbitration & Class-Action Waiver
These Terms, and any dispute arising out of or relating to them or to any OverBuild Labs product or service, are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Binding individual arbitration. Except for disputes that qualify for small-claims court, any dispute between you and OverBuild Labs shall be resolved exclusively through final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Texas, or at your election may be conducted remotely by videoconference or on written submissions. Judgment on the arbitration award may be entered in any court of competent jurisdiction. By agreeing to these Terms, you and OverBuild Labs each waive the right to a trial by judge or jury.
Class-action waiver. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in the state or federal courts located in Texas, and the remainder of this section shall continue to apply.
15. Returns, Refunds, and Support
Hardware sold through third-party marketplaces (such as Etsy) is subject to the return and refund policies of that marketplace, which take precedence where they conflict with this section. Outside of those marketplaces, all hardware sales are final unless otherwise stated in writing at the time of purchase. Firmware is provided free of charge under its open-source license and carries no return entitlement. Community support is provided on a best-effort basis through our public channels; OverBuild Labs is not obligated to provide individual technical support, replacement, or repair.
16. Changes to Terms
OverBuild Labs may update these terms and disclaimers at any time without prior notice. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
